These Terms of Service ("Terms") govern your access to and use of Stakely ("Platform," "we," "us," or "our"). By creating an account, clicking "I agree," accessing, or using the Platform, you agree to these Terms.
The Platform is a service that allows users to create, post, view, distribute, and interact with sports predictions and related content.
The Platform is provided for informational and entertainment purposes only. Predictions on the Platform are user-generated opinions and are not guarantees, promises, or assurances of any outcome.
The Platform does not provide gambling, betting, wagering, bookmaking, or gambling brokerage services.
No bet, wager, or gambling transaction is placed, accepted, settled, or processed through the Platform.
You are solely responsible for any decisions you make based on content on the Platform, including any financial or personal decisions.
Users may post predictions and other content on the Platform ("User Content").
You retain ownership of any intellectual property rights you have in your User Content, to the extent such rights exist under applicable law. However, by submitting, posting, uploading, publishing, or otherwise making User Content available on the Platform, you grant Stakely a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, adapt, modify, format, publish, display, distribute, communicate, promote, analyze, and otherwise use that User Content in connection with operating, improving, marketing, and providing the Platform.
This license includes the right for Stakely to display your predictions in feeds, leaderboards, rankings, profile pages, discovery surfaces, notifications, recommendations, promotional materials, and other features of the Platform; edit, reformat, crop, translate, excerpt, combine, rank, tag, classify, or otherwise process User Content for technical, editorial, ranking, moderation, safety, anti-abuse, and product purposes; and use your username, display name, profile image, prediction history, scores, and related account identifiers as reasonably necessary in connection with the Platform.
You are solely responsible for the content you submit, publish, or share. You must ensure that your content is lawful, does not infringe any third-party rights, and does not violate applicable law.
We may remove, restrict, deprioritize, re-rank, demonetize, or disable any User Content at any time, with or without notice, if we believe it violates these Terms or is otherwise harmful to the Platform or other users.
The Platform, including its design, software, logos, interfaces, layout, databases, features, and original content, belongs to us or our licensors.
Without limiting the above, you acknowledge and agree that Stakely may create, calculate, arrange, compile, format, rank, score, label, classify, index, highlight, summarize, or otherwise generate platform content and platform data from user activity, including prediction scores, rankings, leaderboards, recommendation outputs, trend indicators, badges, categories, statistics, summaries, and similar outputs (collectively, "Platform Outputs").
To the extent permitted by applicable law, all Platform Outputs, and all intellectual property rights in the selection, arrangement, organization, presentation, calculation, methodology, display, and formatting of such Platform Outputs, belong exclusively to Stakely.
For clarity, your raw prediction text remains your User Content subject to the license granted in Section 3, but the Platform's scores, rankings, leaderboards, displays, feeds, indexes, summaries, analytics, and other Platform Outputs are Stakely's content.
We do not guarantee that any prediction, score, ranking, leaderboard position, statistic, or other content on the Platform is accurate, reliable, complete, useful, or error-free.
Any reliance you place on content found on the Platform is strictly at your own risk.
You must be at least the age of majority in your country or region, or otherwise legally permitted to use the Platform.
By using the Platform, you represent that you meet any age or legal requirements that apply to you.
You may need to create an account to access some parts of the Platform.
You agree to provide accurate information and keep your account credentials secure. You are responsible for all activity under your account.
We may suspend or terminate your account if we believe it has been misused, is fraudulent, or violates these Terms.
Some users may be eligible to receive payouts based on the Platform's creator, rewards, or subscriber rules.
Any payout terms, eligibility requirements, payout rates, thresholds, deductions, verification requirements, and payment methods are governed by the separate creator payout agreement or payout rules that apply to those users.
The Platform may use third-party services, including payment processors, subscription providers, hosting services, analytics, infrastructure providers, and moderation tools.
We are not responsible for delays, failures, errors, outages, or losses caused by third-party services.
The Platform, including its design, software, trademarks, logos, databases, text, graphics, platform-generated displays, and original content, is owned by Stakely or its licensors and is protected by applicable intellectual property laws.
Except as expressly allowed by these Terms or by law, you may not copy, modify, distribute, sell, license, scrape, reverse engineer, exploit, republish, or create derivative works from any part of the Platform.
You may not use the Platform's scores, rankings, leaderboards, feeds, structured data, or platform-generated outputs outside the Platform without our prior written permission.
We may suspend, restrict, or terminate access to the Platform at any time if we believe you have violated these Terms, created risk for the Platform, manipulated Platform features, or used the Platform in a harmful way.
We may also remove content, restrict features, freeze creator tools, or stop providing the Platform to you at our discretion, subject to applicable law.
To the fullest extent permitted by law, the Platform is provided on an "as is" and "as available" basis.
We do not make any warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, availability, or non-infringement.
To the maximum extent permitted by law, Stakely is not liable for indirect, incidental, special, consequential, punitive, or speculative losses, including loss of profits, revenue, data, goodwill, or business opportunity.
Stakely's total liability under these Terms will not exceed the greater of EUR 100 or the amounts paid to us by you in the 12 months before the claim arose, except where liability cannot legally be limited.
You agree to indemnify, defend, and hold harmless Stakely, its owners, directors, officers, employees, agents, contractors, licensors, and service providers from any claims, damages, losses, liabilities, costs, and expenses, including reasonable legal fees, arising out of your use of the Platform, your User Content, your violation of these Terms, your violation of any law or third-party right, or your manipulation, misuse, scraping, or abuse of Platform features, scores, feeds, or rankings.
We may update these Terms from time to time.
If we make material changes, we may notify you by posting the updated Terms on the Platform or by other reasonable electronic means. Your continued use of the Platform after the changes take effect means you accept the updated Terms to the extent permitted by law.
These Terms are governed by the laws of Cyprus, without regard to conflict of law rules.
